§ 4-29. Alcohol on city property.

  • (a)

    Except as set out herein below, it shall be unlawful for any person to sell, give away, drink or possess any alcoholic beverages upon property owned by the City of Dublin, Georgia.

    (b)

    Pursuant to a policy proposed by the city manager and approved by the city council, alcohol shall be allowed at the following:

    (1)

    Riverview Golf Course. The City of Dublin may sell alcohol by the drink at Riverview Golf Course.

    (2)

    Emory Thomas Auditorium. Possession of alcohol, but not the sale thereof by the drink, shall be allowed at the Emory Thomas Auditorium, but only at events sponsored by non-profit groups recognized as such under 26 USC 501(c).

    (3)

    Theatre Dublin . Possession of alcohol shall be allowed at Theatre Dublin and the associated parking areas, but only at City approved events. The Downtown Dublin Development Authority is allowed to sell alcohol by the drink at Theatre Dublin and the associated parking areas at events approved by them. The Downtown Dublin Development Authority shall comply with all federal and state regulations concerning the sale of alcohol by the drink when engaged in the activity of selling alcohol by the drink. The Theatre Dublin is specifically excluded from any requirements of section 4-24 - Distance Requirements within this Code of Ordinances.

    (4)

    Carnegie Library. Possession of alcohol, but not the sale thereof by the drink, shall be allowed at the Carnegie Library and the associated parking areas, but only at city approved events.

    (5)

    Bicentennial Plaza. Possession of alcohol, but not the sale thereof by the drink, shall be allowed at the Bicentennial Plaza and associated parking areas, but only at city approved events.

    (c)

    The city council may delegate to any entity managing the above named city properties the power to allow or forbid alcoholic beverages, and to approve events, pursuant to this ordinance. The city may place whatever conditions or limitations on such delegation it feels are appropriate.

    (d)

    Notwithstanding the foregoing, possession of alcohol and sale by the drink of alcohol may be allowed on any city property for a special event upon application by the majority of any board, council, or committee with members appointed by the Mayor and City Council of Dublin. Said application shall be submitted to the city clerk at least fifteen (15) days prior to the event in question and be reviewed and approved or denied by the city manager. Upon receipt of any application under this subsection (d), the city clerk shall immediately forward the application and any other documentation submitted to the city manager and the chief of police for review. The city manager shall review the application and, after consultation with the chief of police, sign the same with his approval or rejection. No special event under this subsection (d) may be approved for more than seven (7) consecutive calendar days. The city manager may place any special restrictions concerning alcohol on city property as he deems in the best interest of the city.

    The applicant shall supply the following information:

    (1)

    The name of the special event;

    (2)

    The city property desired to be included in the exemption from the general prohibition against alcohol on city property;

    (3)

    The name of the board or committee making the request and attach a copy of a letter requesting the exemption with the signatures of a majority of the members of the board or committee applying;

    (4)

    The proposed date(s) of the special event, to be at least fifteen (15) days after the application is submitted;

    (5)

    A description of how the special event will benefit the City of Dublin;

    (6)

    Whether the special event will require a pre-purchased ticket or not;

    (7)

    A description or drawing describing or depicting the specific use of the city property for the special event, including locations of any and all temporary structures that will be placed on the property;

    (8)

    Whether or not alcohol will be sold by the drink, distributed, or simply allowed on the property;

    (9)

    If alcohol will be sold by the drink, the applicant shall also submit copies the corresponding license or licenses permitting the sale of alcohol by the drink or, if no license exists, the corresponding appropriate application for a license to authorize the sale of alcohol by the drink;

    (10)

    Whether or not security will be provided and a description of the security detail to be provided for, if any; and

    (11)

    Any other information requested by the city manager or his/her designee.
