§ 3-42. Appeals.

  • Appeals of the decisions of the building inspector under this article shall be to the City of Dublin Board of Zoning Appeals. The aggrieved party shall file such appeal in writing with the building inspector within ten (10) days of the date of the appealed decision. The board shall consider the appeal at a public meeting conducted within thirty-five (35) days of the filing of the appeal. The aggrieved party or its agent and the building inspector shall be allowed to present testimony and evidence as to whether the decision should be affirmed, reversed or modified. Such testimony and evidence shall constitute the record. The board of zoning appeals shall consider this record in light of the requirements and intent of this article, and shall vote to affirm, reverse or modify the decision at such public meeting. In the event that the board of zoning appeals fails to render a decision on the appeal within thirty-five (35) days of the filing of the notice of appeal, the decision of the building inspector shall stand affirmed. Any person aggrieved by the decision of the board of zoning appeals may appeal to the Superior Court of Laurens County, Georgia, within thirty (30) days of the board of zoning appeal's decision.
